HC bar association to challenge shifting order in SC

The Uttarakhand High Court bar association passed a proposal to file an appeal in the Supreme Court challenging the HC order to shift the court from Nainital. The proposal was passed in a general meeting of the bar association held here on Monday. On May 8, the HC bench of chief justice Ritu Bahri and justice Rakesh Thapliyal passed an order stating that shifting of the HC from Nainital is necessary in greater public interest. It also directed the chief secretary to select a suitable location for the HC and submit its report in the court within a month.
Earlier, the HC had asked the bar association to suggest an alternative space for the court within a week. However, it passed the order regarding relocation of the court on the next day. In the bar association meeting on Monday, advocates expressed their views against the relocation. They claimed that they had nurtured the HC in Nainital so it was important to approach the SC against the HC’s order. Advocate DK Joshi opined that the decision had been taken in haste. Jitendra Chowdhary suggested that a committee should be formed and a special leave petition should be filed in the apex court after necessary preparations. The bar association chief DCS Rawat said that the association will file an SLP in the Supreme Court. A senior advocate of the apex court will be contacted soon, he added.
