Arya asks Modi govt to go through previous Law commission report on UCC

The leader of opposition (LoP) in Uttarakhand assembly Yashpal Arya has said that instead of creating a fracas in country on the issue of Uniform Civil Code (UCC), the Narendra Modi government should accept the proposals submitted by the Law Commission in the year 2018 and initiate the process of inculcating logical and constitutional changes in the family laws of all the social groups.

He said that from last one week the opinion of people on UCC is being sought. Arya said that the Law Commission headed by Justice Chauhan had sought public opinion on UCC and that time it had received 75,378 suggestions. On the basis of these suggestions the Commission had submitted a 185- page report to the government. Arya said that in its report the Commission had opined that it is neither necessary nor desirable to prepare one code in view of different family laws of different social groups in the country.

He said that the BJP government’s decision to repeat the process by the current Law Commission suggests that the report of the previous Law Commission was not politically conducive for it.

The LoP added that the drafting committee of the constitution headed by Baba Sahib BR Ambedkar after much deliberation had put the UCC in the section 44 of the directive Principles of State policy. The framers of the constitution wanted that the implementing UCC would be a target for the country.

Arya said that India is the biggest country of the world in terms of the population and here people of many religions and faith reside. There are different customs of marriage, divorce, inheritance and division of ancestral property in people of even one religion. There are both patriarchal and matriarchal systems in the social groups under Hindu religion and there are different customs in tribal populations and the government refrain from foisting anything on the people.
