HC stays lower PCS recruitment on the issue of reservation for physically disabled candidates

In latest Uttarakhand news, the Nainital High Court ordered a stay on the recruitment process for the Lower Provincial Civil Services (PCS) involving 190 posts while responding to a petition related to Uttarakhand Public Service Commission (UKPSC) having surrendered six posts reserved for the candidates with physical disabilities. Notably, the petitioner Vinod Singh appealed to the court to cancel the commission’s decision to surrender these six posts reserved for physically disabled persons. The petitioner said that UKPSC being a mere agency did not have the power to surrender any post to the government that had already been designated by the government itself. The single bench of the High Court comprising Justice Manoj Kumar Tiwari directed the State government and the commission to respond to the matter within three weeks. The next hearing would be held in August.
As per the petition, Uttarakhand Public Service Commission (UKPSC) had advertised vacancies for 190 Lower PCS posts in August 2021. Accordingly, after the exam processes were completed, the successful candidates in the final examination were scheduled to be interviewed on July 24 2022. This was when the commission surrendered these six reserved posts for the specially abled to the State government.
