RSS is learnt to have objected to the order which mandated incorporation of provisions of section 104-A of Waqf Act in all sale deeds of property in U’khand
A government order which would have mandated an undertaking in every sale deed of land in Uttarakhand that the deed would stand cancelled if the property concerned is found to be a Waqf property has been hastily withdrawn. The said order was issued by head of department Stamps and Registration and inspector general (IG), Registration, Ahmed Iqbal on July 31. Its purported objective was to safeguard the Waqf properties and prevent their illegal sale and purchase in the state. The order stated that it had been noticed that the committees handling Waqf properties, caretakers and land mafia are involved in sale and purchase of Waqf properties which is illegal as per the section 104- A of Waqf Act. It directed all district magistrates that provisions of the above mentioned section of Waqf Act should be included in the sale deeds of land. This order of July 31 this year mandated inclusion of the sentence- “The said property is not a Waqf property as defined in section 3 (d) of the Waqf act 1995 (amended 2013). In future, if the said property is found to be Waqf property, then this sale deed under section- A of the Waqf Act shall be void ab initio and the property shall be vested with Waqf board without any compensation under provisions of section -A of the Act’’, in all the sale deeds of the state.
According to reliable sources, the Rashtriya Swayamsevak Sangh (RSS) took objection to the order and forced the state government to withdraw it. The state government took prompt cognisance of the objection and the contentious order was withdrawn three days later on August 4. “There was no need for such an order in the state. Any sale and purchase of Waqf property is illegal but there is no need to include the provisions in every sale deed,’’ said a leader of BJP.
When The Pioneer contacted IG, Registration, Ahmed Iqbal and asked him the reason for withdrawal of the order he said that since the issue is sub-judice he would not comment on it.
