SC refuses to legalise same- sex marriage

Asks Parliament to take the call

The Supreme Court declined to grant legal recognition to same- sex marriage and said that it is the special prerogative of the Parliament to decide.  The Chief Justice of India D Y Chandrachud said that right of marriage is not among the fundamental rights of the citizens. He also made it clear that the court cannot make law and it can just interpret it and give effect to it. The Constitution Bench of the Supreme Court pronounced the verdict after hearing 21 petitions amidst differences among the judges on the matter. The complexity of the case can be gauged from the fact that four of the five judges have written separate judgments. However, the apex court of the country asked the Centre to constitute a committee to decide the contentious matter.
