Son evicts elderly parents after property gift, DM restores property right to couple

After securing a bungalow and business property through a gift deed from his elderly parents, a man in Dehradun reportedly began forcing them out of their own home.

Taking immediate cognisance of the matter, Dehradun district magistrate Savin Bansal cancelled the gift deed and restored the entire 3,080 square feet property to the elderly couple. Bansal informed that the couple, Sardar Paramjeet Singh and his wife Amarjeet Kaur, had transferred the ownership of their two-hall property to their son, Gurvinder Singh, under specific conditions. These conditions reportedly included providing for their maintenance, allowing them to live on the premises and ensuring they could freely meet their grandchildren.

Bansal said that once the property was transferred, the son allegedly violated these terms and began distancing himself from his parents and restricted their access to their grandchildren, as per the parents claim. The elderly couple then approached the tehsil office, local police and subordinate court but found no resolution. Eventually, they registered their complaint at the DM’s court. During the very first hearing, the DM issued notices to Gurvinder Singh and others involved and public notice was also issued through advertisement.

The DM said that despite receiving adequate opportunities to respond, the opposition neither submitted objections nor appeared before the court. Using the special powers granted under the Maintenance and Welfare of Parents and Senior Citizens Act, the DM ruled in favour of the elderly couple. The violation of the deed’s terms and disobedience of instructions led to the cancellation of the gift deed. The property was legally restored in the name of the parents, as per Bansal.

The decision prompted an emotional response from the couple, who wept in the courtroom. The DM said that this verdict marks a firm stance in favour of senior citizens and a strict warning against the misuse of legal documents for personal gain.
