Halala included as crime in first chargesheet after UCC

For the first time in Uttarakhand, Haridwar police have included Halala as a crime in a chargesheet under Uttarakhand Civil Code. A woman from the Bhagwanpur area of the district   had filed a complaint against her husband and his family members of dowry-related harassment, triple Talaq and pressuring her to go for Halala. Nine accused were named in the chargesheet filed by the police.

Police have taken action in this case under Sections 32(1)(ii) and 32(1)(iii) of the UCC, Uttarakhand 2024 (Amendment 2026). These sections prohibit and punish practices such as Halala. In addition, Sections 115(2) and 85 of the Bharatiya Nyaya Sanhita 2023 have also been included in the case. Charges related to triple Talaq have been added under Sections 3 and 4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019. Sections 3 and 4 of the Dowry Prohibition Act, 1961 have also been added to the case.

A woman had filed a complaint on April 4 against nine people, including her husband Danish and members of her in-laws’ family. She said in the complaint that she had been thrown out of the house.  

The officials said that the inquiry had supported the allegations made by the complainant. Thereafter, police added more legal sections in the case and included Halala as an offence in the chargesheet.

Police have named the husband, father-in-law, mother-in-law, brothers-in-law, sister-in-law and another relative in the case. A chargesheet has now been submitted in court.

None of the accused has been arrested in this case so far. “The case was registered around two months ago. There is no clear provision for arrest under the sections included in the case. Therefore, no accused has been arrested. Further action will now be taken according to the directions of the court,” said the superintendent of police (rural), Haridwar,  Shekhar Chandra Suyal.
